Part 137 Certification Process
Step One: Complete FAA Registration for Your Aircraft
Registering your UAS with the FAA is a straightforward process. Aircraft under 55 lbs. may be registered online, while those 55 lbs. and above require documentation submission through the Aircraft Registration Branch. For drones over 55 lbs., operators must file AC Form 8050-1 (Aircraft Registration Application) along with proof of ownership - either AC Form 8050-2 (Aircraft Bill of Sale) or AC Form 8050-88A (Affidavit of Ownership for non-U.S. manufactured aircraft). Each UAS will receive a unique FAA registration number. Step Two: File for FAA 44807 Exemption
Spray drone operators are required to obtain a 44807 exemption from the FAA prior to conducting operations. As part of our services, NII Corp assists clients in preparing and submitting their 44807 exemption applications to ensure compliance with federal regulations. Based on our experience, the approval process typically requires 2 - 3 months when initiated from the beginning.
The FAA has recently adopted a blanket 44807 exemption framework that applies to a pre-approved list of spray drones. Under this system, once an exemption is granted for any aircraft on the approved list, the operator is authorized to legally operate any other drone included in that list - streamlining what previously required separate exemptions for each individual model.
Importantly, if you already hold a valid 44807 exemption for any drone on the approved list, you are not required to reapply in order to obtain your Part 137 certification, as the prerequisite exemption is already satisfied.
Step Three: File FAA Form 8710-3 Application
Once the FAA grants the required 44807 exemption, applicants must submit FAA Form 8710-3 via email to UAS137Certificates@faa.gov. This is a concise two-page form, and NII Corp provides detailed guidance to ensure it is completed and filed correctly.
Historically, applicants were required to apply through their local Flight Standards District Office (FSDO) and complete an in-person inspection and skills test administered by FAA personnel. This approach often resulted in significant delays due to variations in FSDO capacity, resources, and expertise.
Under the current system, applicants instead self-certify the qualifications and operational capabilities that were previously verified by the FSDO. By submitting Form 8710-3 directly to the FAA, the process has been streamlined significantly, reducing administrative burdens and accelerating approval timelines.
Step Four: Secure FAA Part 137 Approval
Following a comprehensive review, the FAA will notify the applicant regarding the approval status of their Part 137 Certification. Once approved, and provided all other regulatory requirements are met (see details below), the applicant is authorized to operate their spray drone commercially under Part 137 regulations.
